General

Personal data

Personal data refers to specific details regarding the personal or factual circumstances of an identified or identifiable natural person. This includes information such as your full name, your address, your telephone number, your position and your company. Information that cannot be directly linked to your actual identity – such as the number of users of a website – does not constitute personal data.

Data collection and use for contract processing and when opening a customer account

We collect personal data when you voluntarily provide it to us as part of your order, when contacting us (e.g. via the contact form or email) or when opening a customer account. The data collected is indicated in the relevant input forms. We use the data you provide for contract processing and to handle your enquiries.
Once the contract has been fully processed or your customer account has been deleted, your data will be blocked for further use and deleted after the expiry of the retention periods under tax and commercial law, unless you have expressly consented to further use of your data or we reserve the right to use your data beyond this, which is permitted by law and about which we inform you below. You may delete your customer account at any time by contacting us via the contact details provided below.

Data transfer for the fulfilment of the contract

All payment data is transmitted in encrypted form, meaning that the information cannot be read by unauthorised persons during transmission over the internet. This is indicated by the closed padlock icon in your browser’s status bar. Certification is provided by the global company Thawte.

Your email address is required, amongst other things, to send you confirmation of your order. Under no circumstances will this or any other address data be passed on to third parties. Exceptions to this are our service partners who require your data for order processing (e.g. the delivery company responsible for shipping and the bank responsible for payment processing). In these cases, the processing of the transmitted data is limited to the minimum necessary. When selecting our service providers, we take great care to ensure that they also comply with the legal provisions on data protection and conclude appropriate data processing agreements (Art. 28 GDPR) with them.

Consent to the use of your data for marketing purposes

We will only use your personal data for advertising purposes if you have expressly consented to such use. We will send you, in moderation, only information that may be of particular interest to you, such as changes to the shop’s range, services, products, special offers and promotions. Your data will never be passed on to third parties for advertising purposes.

Where applicable, you may have given the following consent after placing your order: “I would like to subscribe to the newsletter and be reminded by Trusted Shops via email of the opportunity to submit a customer review. I can withdraw my consent at any time.”
Provided you have given us your express consent as stated above, we will use your email address for our own advertising purposes and to receive a request from Trusted Shops GmbH, Subbelrather Str. 15c, 50823 Cologne, to submit a customer review of the service received via the Trusted Shops customer review system.
This consent may be withdrawn at any time with future effect (e.g. by email to datenschutz@spilkers-jungpflanzen.de).

Use of data when subscribing to the newsletter

If you wish to subscribe to the newsletter offered on the website, we require your email address. You can unsubscribe from the newsletter at any time free of charge via the link provided in the newsletter.
We have entered into a contract with our email marketing service provider, Inxmail, regarding the procedure for commissioned data processing. This ensures that our service provider complies in every respect with the strict requirements of German data protection law when sending the newsletter. It also ensures that your data is stored only within the EU with a high level of protection. Your data is not stored on servers outside the EU.

Use of data for email advertising without newsletter subscription

If we receive your email address in connection with the sale of a product or service and you have not objected to this, we reserve the right to send you emails in moderation regarding similar products from our range to those you have already purchased. You may revoke this use of your email address at any time by sending a message to the contact details provided below. Or you may object via a link provided for this purpose in the promotional email, without incurring any costs other than the transmission costs according to standard rates. The
legal basis for the use of your data is Article 6(1)(f) of the GDPR, taking into account Section 7 of the Unfair Competition Act (UWG) and Article 16 of the ePrivacy Regulation (ePVO).

Use of data for postal advertising and your right to object

Furthermore, we reserve the right to store your first name and surname, your postal address and – insofar as we have received this additional information from you within the framework of the contractual relationship – your title, academic degree, and your professional, industry or business designation in summarised lists and to use them for our own advertising purposes, e.g. to send you interesting offers and information about our products by post. You may object to the storage and use of your data for these purposes at any time by contacting us via the contact details provided below.

Use of Adobe Typekit web fonts

Adobe Typekit web fonts are used on this website. Typekit is a service provided by Adobe. This service makes fonts available which are displayed in the user’s web browser following a server request to Adobe (in the USA). In doing so, Adobe stores at least the IP address of the browser on the user’s device. Further information can be found in Typekit’s privacy policy, which you can access here: Typekit Privacy Policy: https://www.adobe.com/privacy/policies/typekit.html

Use of Google Tag Manager

In connection with Google Analytics and Google Ad Services, we also use Google Tag Manager provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA (hereinafter: “Google”). In this context, Google acts as a data processor on our behalf. We have entered into a corresponding data processing agreement with Google in accordance with Article 28 of the GDPR.

This solution enables Google Analytics and Google Ads to be technically integrated into the website. Google Tag Manager functions as a container in which the web analytics and marketing tools to be deployed on the website are tagged and stored using a so-called tag. This is a code fragment that specifies which data may be collected by the tools used and under what conditions. Further privacy information from Google regarding this tool can be found here: marketingplatform.google.com/about/analytics/tag-manager/use-policy/.

Use of Google Analytics

In order to optimise our website more effectively to meet the needs of our users, we analyse the usage behaviour of visitors to our website (e.g. which content is particularly popular? Which is not?) – Google Analytics is used for this purpose. This is a web analytics service provided by Google Inc. (“Google”).

Google Analytics uses so-called “cookies”, text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

By activating IP anonymisation on this website, your IP address will be truncated within Member States of the European Union or in other signatory states to the Agreement on the European Economic Area prior to transmission. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services relating to website and internet usage to the website operator.

The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. In addition, we have extended Google Analytics on this website with a command to ensure the anonymised collection of IP addresses.
You can prevent the storage of cookies by adjusting your browser software settings accordingly; however, we would like to point out that in this case you may not be able to use all the functions of this website to their full extent. You can also prevent the collection of data generated by the cookie and relating to your use of the website (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plug-in available via the following link: http://tools.google.com/dlpage/gaoptout?hl=de.As an alternative to the browser add-on or within browsers on mobile devices, please click this link (Disable Google Analytics) to prevent Google Analytics from collecting data on this website in future. This will place an opt-out cookie on your device. If you delete your cookies, you will need to click this link again.

Further information can be found at http://www.google.com/intl/de/analytics/privacyoverview.html.

Google AdServices Conversion/Remarketing

We use the remarketing and conversion tracking functions of Google Ads, a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA (hereinafter: “Google”), on our website. In this context, Google acts as a data processor. We have entered into a data processing agreement with Google in accordance with Article 28 of the GDPR.

The remarketing function serves to present interest-based advertisements to website visitors within the Google advertising network. The conversion tracking function, in turn, enables us to measure how effective the advertisements we place and which are clicked on by website visitors are, and whether these lead to profitable activities on the website, such as purchases or registrations. When using Google AdServices, the following data is collected and transmitted to Google in the USA: - Device and browser data (host name, browser type, referrer, language),
- IP address, as well as the respective user interaction on our website and on other websites where our advertisements are displayed

  • e.g. which page a user visits,
  • which products the user selects and purchases,
  • which adverts a user clicks on.

- In addition, a random, pseudonymous ID is assigned to a user via a cookie, to which the aforementioned information is linked.
Further information on data protection for Google Ads can be found at: ads.google.com/intl/de_de/home/faq/gdpr/

Use of Facebook and Google+ plugins

Our website uses so-called social plugins (“plugins”) from the social networks Facebook and Google+. These services are provided by Facebook Inc. and Google Inc. (“providers”).
Facebook is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). Google+ is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). An overview of the plugins and their appearance can be found here: https://developers.facebook.com/docs/plugins or https://developers.google.com/+/web/

When you visit a page on our website that contains such a plugin, your browser establishes a direct connection to the servers of Google or Facebook. The content of the plugin is transmitted directly from the respective provider to your browser and integrated into the page. By integrating the plugins, the providers receive the information that your browser has accessed the relevant page of our website, even if you do not have a profile on the relevant social network or are not currently logged in. This information (including your IP address) is transmitted directly from your browser to a server of the respective provider in the USA and stored there.

If you are logged in to one of the social networks, the providers can directly associate your visit to our website with your profile on Facebook or Google+. If you interact with the plugins, for example by clicking the ‘Like’ button or the ‘+1’ button, the relevant information is also transmitted directly to a server operated by the providers and stored there. The information is also published on the social network and displayed to your contacts there.

For details regarding the purpose and scope of data collection, as well as the further processing and use of the data by the providers, and your rights and settings options for protecting your privacy, please refer to the providers’ privacy policies. Please note that we cannot accept any responsibility or liability for third-party content or privacy policies. Please ensure you are aware of the applicable privacy policies before submitting personal data to these websites.

Facebook’s privacy policy:
http://www.facebook.com/policy.php

Google’s privacy policy:
https://developers.google.com/+/web/buttons-policy

If you do not wish Google or Facebook to directly link the data collected via our website to your profile on the respective social network, you must log out of the relevant network before visiting our website. You can also completely prevent the plugins from loading by using add-ons for your browser, e.g. the script blocker ‘NoScript’ (http://noscript.net/).

Google Maps

Event information may include maps from Google Maps. To this end, the relevant programme libraries or map content are retrieved from Google’s servers. In this context, we would like to point out that this use may involve accessing external Google servers in the USA. Unfortunately, we are currently unaware of whether Google logs and further processes this server request. However, we assume that Google’s privacy policy also applies in this regard, i.e. Google will in any case store your IP address for a period of several months.

YouTube plugins (videos)

This website uses plugins from Youtube.de/Youtube.com, which – represented by Google Inc. – is operated by YouTube, LLC, Cherry Ave., USA. When you visit pages on our website that contain such a plugin, a connection is established with the YouTube servers and the plugin is displayed on the website via a message sent to your browser. This transmits information to the YouTube server regarding which of our web pages you have visited. If you are logged in as a member of YouTube at the time, YouTube associates this information with your respective personal user accounts on these platforms. When using these plugins, such as clicking on a video’s play button or submitting a comment, this information is associated with your YouTube user account, for example, which you can only prevent by logging out before using the plugin.
Information on the collection and use of data by the platform or plugins can be found in the privacy policy: http://www.google.com/intl/de/policies/privacy/

Do several people use your computer? Then please log out!
